Welcome to Plema, an AI-powered image generation, editing, and creative transformation platform (the "Service"). These Terms and Conditions (the "Terms") govern your access to and use of https://plema.ai, Plema's tools, account features, paid services, and related products.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

Eligibility

You must be at least 18 years old or have reached the age of majority in your jurisdiction to use the Service. If you use the Service on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms.

Account Registration

Some features may require an account. You agree to provide accurate, complete, and current information and to keep it updated. You are responsible for safeguarding your login credentials and for all activity under your account. You must notify us promptly if you suspect unauthorized access or any security issue involving your account.

Use of the Service

Permitted Use

Plema grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for lawful purposes, subject to these Terms and any applicable policies, plan limits, payment requirements, or technical restrictions.

Prohibited Conduct

You agree not to:

Use the Service for unlawful, harmful, abusive, deceptive, infringing, or otherwise prohibited purposes
Upload, generate, edit, publish, or share content that violates these Terms, our policies, or applicable law
Reverse engineer, decompile, disassemble, copy, or attempt to extract source code or underlying models from the Service
Use bots, scrapers, automated systems, or other unauthorized methods to access or overload the Service
Interfere with or disrupt the Service, servers, networks, security systems, rate limits, or access controls
Use the Service to infringe or misappropriate intellectual property, privacy, publicity, or other rights
Misrepresent AI-generated content as human-created where disclosure is required by law or context
Submit sensitive personal data without a lawful basis, consent, and appropriate authorization

User Content

Ownership and Responsibility

You retain ownership of content you upload, submit, create, or generate through the Service, including photos, images, text prompts, style selections, and generated outputs ("User Content"), subject to any third-party rights and applicable law.

You are solely responsible for your User Content and for ensuring that you have all rights, licenses, consents, and permissions required to submit, generate, edit, publish, or share it through the Service.

License to Plema

By submitting User Content to the Service, you grant Plema a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, use, reproduce, modify, process, display, transmit, and create derivative works from User Content as needed to operate, provide, secure, support, improve, and promote the Service.

If you choose to make User Content public, including by publishing it to galleries, feeds, showcases, community areas, or other public features, you grant Plema and its affiliates a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, sublicensable, and transferable license to use, display, distribute, reproduce, modify, adapt, publish, and create derivative works from that public content in any media or channel, including for Service operation, model and product improvement, marketing, and promotional purposes.

Content Restrictions

You agree not to upload, generate, edit, publish, or share User Content that:

Is illegal, harmful, abusive, defamatory, threatening, harassing, hateful, or discriminatory
Contains pornography, explicit sexual material, child exploitation, or content that endangers minors
Depicts or promotes excessive violence, terrorism, extremist activity, unlawful political manipulation, or other prohibited conduct
Infringes copyrights, trademarks, rights of publicity, privacy rights, or other third-party rights
Uses another person's likeness, voice, identity, private information, or confidential information without required consent
Contains malware, viruses, phishing attempts, spam, or harmful code
Is false, misleading, impersonating, deceptive, or likely to cause harm
Violates any applicable law, regulation, platform rule, or contractual obligation
Is otherwise inappropriate, disruptive, or likely to create risk or liability for Plema, our users, or third parties

Plema may use automated and manual systems to detect and restrict prohibited content. We may remove content, limit features, suspend or terminate accounts, decline generations, or report unlawful activity where appropriate.

Intellectual Property

Plema Materials

The Service, Website, software, designs, interfaces, models, prompts, workflows, templates, logos, trademarks, text, graphics, and other materials provided by Plema are owned by Plema or its licensors and are protected by intellectual property laws.

Except for the limited license expressly granted in these Terms, you receive no rights in Plema's intellectual property. To use Plema materials in a way not permitted by these Terms, contact support@plema.ai.

Feedback

If you provide feedback, suggestions, ideas, or recommendations about the Service, you assign to Plema all rights in that feedback and agree that we may use it without restriction or compensation.

Payment and Subscription

Fees

Some features may require payment, credits, subscriptions, or other paid access. You agree to pay all applicable fees associated with your use of paid features. Plema may change fees, billing methods, plan features, or credit pricing at any time with notice where required.

Billing

Payments may be processed by third-party payment processors. By providing payment information, you authorize Plema and our payment processors to charge your selected payment method for applicable fees, taxes, subscriptions, renewals, and other charges.

Refunds

Except where required by law or expressly stated by Plema, payments are non-refundable. Plema may provide refunds, credits, or adjustments at its sole discretion.

Subscription Cancellation

You may cancel a subscription through the account billing settings where available or by following the instructions provided by the applicable payment processor. After cancellation, your paid access may remain active until the end of the then-current billing period. Cancellation requests must be submitted before the next billing date to avoid renewal charges. We do not provide partial refunds or prorated credits for unused time, mid-cycle cancellations, or downgrades unless required by law.

Termination

Termination by You

You may stop using the Service at any time and may request account deletion where available.

Termination by Plema

We may suspend, restrict, or terminate your account or access to the Service at any time, with or without notice, if we believe you violated these Terms, created risk for Plema or others, failed to pay amounts owed, or used the Service in a harmful, unlawful, or abusive manner.

Effect of Termination

Upon termination, your right to access and use the Service ends immediately. Provisions that by their nature should survive termination will survive, including those related to intellectual property, payment obligations, disclaimers, limitation of liability, indemnification, and dispute-related terms.

Disclaimers and Limitation of Liability

Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Plema disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and reliability.

Plema does not warrant that the Service will be uninterrupted, secure, error-free, free from harmful components, or that generated outputs will meet your expectations or be suitable for any particular purpose.

Limitation of Liability

To the maximum extent permitted by law, Plema will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, or use, arising out of or related to your use of or inability to use the Service, whether based on contract, tort, warranty, statute, or any other legal theory, even if Plema has been advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless Plema, its affiliates, and their respective officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to your use of the Service, your User Content, your violation of these Terms, or your infringement or violation of any rights of another person or entity.
